TERMS & CONDITIONS

1. Wangi and Beyond Houseboats will hold the security bond of $2000 from the Hirer and will returned back to the Hirer within 7 business days subject to deductions payable by the Hirer including:

(a) additional fees for late return to mooring at end of hire period if applicable;
(b) the cost of additional cleaning (if required);
(c) the cost of repair or replacement of items damaged or lost during hire period;
(d) All fuels will be deducted from bond
(e) any other amounts for which the Hirer is liable including damages to other persons’ property, this amount can exceed the bond amount and the hirer is responsible for the payment.

2. The owner will provide instruction to the Hires/Operator in respect of:

(a) The Hirer personally accepts full responsibility for the care and safety of the houseboat including all fixtures, fittings and accessories and also accepts full responsibility for the actions of all persons permitted on board during the period of hire and in particular the Hirer will comply with all directions given by, the Owner with regard to the operation of the houseboat and its accessories and will comply with Lake Macquarie Water Ways Navigation Regulations and all other navigation rules.
(b) The Hirer is liable for the cost of the repair of any damage to the houseboat, its fixtures, fittings or accessories during the period of hire. Any damage must be reported to the Owner as soon as possible, Damaged items may be repaired or replaced at the option of the Owner.
(c) Any items noted to be damaged prior to the beginning of the hire period should be brought to the attention of the Owner at the time of the pre-hire inspection
(d) The Hirer is liable for the replacement cost of any items missing from the Houseboat at the end of the hire period.
(e) If the houseboat is not returned to the organised meeting point at the end of the hire period the hirer may be liable for an additional fee at the owner’s discretion.
(f) The Hirer will pay the cost of all fuels used from the beginning of the hire period until the houseboat is returned to the Owner.
(g) The Hirer is liable for any loss, damage or injury to any person or to any property which may result from anything done by the Hirer or by any person on board the houseboat.
(h) The amount payable by the Hirer pursuant to the provisions of this clause is not limited by the amount of security bond. The Owner may retain the security bond until the amount for which the Hirer is liable has been determined.

4. The Hirer shall NOT:
(a) permit more persons to be on board the houseboat than the stated number allowed by AMSA as stated on the certificate of survey for the vessel.
(b) permit any person to operate the houseboat who
(i) is under the age of twenty-five years;
(ii) does not possess and produce for notation by the Owner a current full vehicle
drivers’ license or boat operators’ license;
(iii) is under the influence of alcohol or any drug or drugs;
(iv) has not been given instructions in respect of relevant navigation rules and regulations;

(c) drive, navigate or move the houseboat after sunset or before sunrise or permit anyone else to do so
(d) take or permit to be take the houseboat outside the strict boundaries identified by the owner and on all maps within the houseboats, these specifically include the sand islands and the Swansea channel, costs can be taken from the bond if failure to comply with these rules as well as assistance being needed/rescue and/or damages to boat from it being grounded
(e) bring the houseboats to any jetties or fixed objects as this can cause damage, any damages incurred will be payable by the hirer and this may exceed the bond.
(f) permit an occupied craft to be towed other than those agreed with by the owner
(g) adjust or interfere with or permit any other person to adjust or interfere with the operation of the motor, gas regulators or any fixtures or fittings;
(h) tie the houseboat up to other vessels as this can cause damage
(i) permit any person for any reason whatsoever to be on the forward and back sections of the upper deck outside the rails as this can cause danger to guests and damage to the roof.
(j) permit to be brought on the houseboat any of the following, any Electrical and/or Gas Appliances or any pets.
(k) use the emergency equipment for fun, emergency equipment is strictly for use in case of emergency, using this not for emergency situations can incur a fee for replacement. If it is used for emergency it should be reported to the Owner as soon as possible via telephone.

5. If the Hirer shall breach any of the terms or conditions of this agreement the Owner may terminate the hire period without prejudice to the Owner’s other rights under this agreement.

6. The Owner will endeavor to have the houseboat motor and all fixtures, fittings and accessories in good working order. The Hirer shall not be entitled to any compensation of any loss or damage sustained as a result of unforeseen mechanical breakdown of equipment failure or any loss of time resulting from such breakdowns or failures during the hire period. The hirer accepts the hire period even in the event of certain weather conditions and other unforeseen circumstances. This decision to change hire periods due to unforeseen conditions is up to the owner’s discretion.

7. You are responsible for taking all precautions you believe necessary or advisable to protect you against any claim, damage, loss or hazard that may arise by hiring the houseboat for the period agreed for all guests onboard.

8. You hereby release and forever waive any and all claims you may have against Wangi and Beyond Houseboats, (including but not limited to claims based upon our negligence or the negligence of us, for any loss or damage you sustain whilst using the houseboat for the agreed hire period and for all guests onboard. The use of the houseboats from Wangi and Beyond are at your own discretion and risk and you agree to take full responsibility for damages to any other watercraft/land and person including yourself and the other guests onboard and those not on the houseboat including the community and individuals on Lake Macquarie.

9. Please ensure you take all valuables with you as we do not take any liabilities if they are left in your vehicle and do not take responsibility for theft or damage to your vehicle whist it is parked on our property.

10. At any time the owner can request the hirer to move to a specific mooring or area due to weather conditions. The hirer must remain at the specified area and/or mooring until notified by owner.
